Who would manage your business if you suddenly couldn’t!?

Have you EVER considered what would happen to your business if you were suddenly unable to manage it yourself? WHO would be legally entitled and able to manage the day to day running of your business should you lose mental capacity?

Business Lasting Powers of Attorney (LPAs) allow the donor (the business owner) to appoint a suitable attorney to make decisions concerning their business interests when they’re unavailable OR lack mental capacity to manage it.

If there is no business LPA in place, you may be putting your business at risk. Just as a few examples:

…..If one of your bank account signatories lacks capacity, the bank could potentially freeze the account to protect the now vulnerable adult…and if there is an overdraft attached to your business, the possibility of the bank freezing the account is higher!

…..Any contracts entered into by a person who had capacity, but now lacks capacity, may become unenforceable owing to their incapacity.

…..Paying creditors, employees or tax becomes difficult as does running the business generally with a businessperson who now lacks capacity.

…..Investors may require their investments to be returned.

By appointing a business LPA attorney, these issues may not arise and you can be reassured you are doing your utmost to safeguard your business.

If you lost the ability to manage your business without a business LPA in place, an application would need to be made to the Court of Protection to have a deputy appointed. This might take months (or even longer!), during which time the business is exposed to uncertainty of survival. Also bear in mind the person chosen to manage your business will be picked by the Courts and might not be the person you’d ideally want managing your affairs……

Michael Wadsworth is a Director of Wadsworths and head of our Wills and LPA Department. With over 16 years of experience in this field and thousands of happy clients, Michael is able to advise on the best way forward to protect your business and personal affairs and get an LPA in place.

C&W in Business Article, May 2020

Wadsworths Solicitors is a well-respected, community-minded law firm based in Solihull. Building on its successful 33-year history and an enviable reputation, this year has seen the company grow its family tree by adding two new offices.

In February 2020, the firm opened its second office in Henley-in-Arden and office number three came through an acquisition in April, with Wadsworths bringing Duncan Watts Family Lawyers of Warwick into the fold.

Boasting thousands of satisfied clients, Wadsworths offer an array of legal services for both families and businesses. They pride themselves on working to the highest standards of professional service, an approach that’s been recognised by numerous awards programmes including the Federation of Small Businesses and the Birmingham Post Business Awards. Most recently they were shortlisted for both ‘Company of the Year’ and ‘Family Business of the Year’ at the Midlands Service Excellence Awards 2020.

Wadsworths also has a well-earned reputation for reliably serving the community, and proudly invests a proportion of its turnover into support for local charities, schools and events. The firm also supports discounted legal fees for workers in the NHS, Police and Armed Forces.
Founded in 1986, the firm now employs 29 staff across three locations, including ten solicitors and other fee earners. Four of the staff, including two of the firm’s Directors, are members of the founding Wadsworth family.

Wadsworths Solicitors arrives in Henley-in-Arden

In February 2020, Wadsworths Solicitors announced the opening of their second office in the beautiful Warwickshire town of Henley-in-Arden. Located at 129 High Street, the office has helped the firm to meet the growing demand for its services.

John Wadsworth, Managing Director, said: “We chose to open our second office in Henley-in-Arden for several reasons, not least because of the town’s thriving community and large number of independent businesses.”

Alexandra Tait, Director added, “This has been an exciting time for the team at Wadsworths Solicitors. We’ve enjoyed further assisting our Henley-in-Arden based clients by opening an office on their doorstep as well as welcoming new customers, who can safely leave personal and business matters in the hands of our expert team.”

Duncan Watts Family Lawyers in Warwick joins Wadsworths

Wadsworths went on to acquire Duncan Watts Family Lawyers in Warwick on 3 April 2020. Like Wadsworths, the niche family law firm has had over 30 years of success. The team-up increases the firm’s overall presence to three locations and 29 staff. This includes Martin Croom, a partner at Duncan Watts, who now joins Wadsworths as Head of the Warwick office.
The town centre offices at 26 Market Place, Warwick will still be home to the family law specialists of Duncan Watts, with the addition of Wadsworths’ complete range of legal services across both family and business law. The office will be re-badged as ‘Wadsworths Solicitors, incorporating Duncan Watts’ later this year.

Croom stated, “We are excited to be joining Wadsworths and expanding our offering of legal services to the people of Warwick and surrounding areas. Our clients will benefit from the broader expertise we can now provide across a wider range of services, meaning that we can cover all their legal needs under one roof.”

John Wadsworth, commented: “We are delighted that the team at Duncan Watts are joining us at Wadsworths. Duncan Watts has an excellent reputation in the field of family law and we are thrilled that this expertise will be added to our existing service provision.”
He added “We had been looking to open a Wadsworths office in Warwick for some time, given how thriving and vibrant the town is. This tie-up with Duncan Watts allows us to establish ourselves in the area with an existing firm and client base. We look forward to building on the firm’s close links to the community and extending our charitable support activities into the Warwick and Henley-in-Arden areas too.”

The future of Wadsworths Solicitors in the Midlands

On the question of further expansion, John Wadsworth said “We will continue to look for new opportunities in Warwickshire and the West Midlands in the months and years ahead. We’re committed to acting in the best interests of our clients, so if continued expansion meets that goal, we’ll always be open to the possibility.”

Lockdown Statement

Following the announcement last night regarding the ‘lockdown’ of the country due to coronavirus we are posting to make you aware of changes to our working practices.

We, as a business, are remaining open, with a skeleton staff of just 6 present in the office, including 3 of the management team. We need to stay open as we have clients who are about to complete their house move, clients whose legal cases are imminently to have court hearings, and clients who need to urgently update and sign their Will.

Although official clarification of the status of solicitors’ appointments is awaited from the Government after last night’s announcement, Solicitors were classed as ‘key-workers’ for the purposes of children attending school last week, which is what we have based our policy on.

All other staff are now working from home.

Our phone lines remain operational and all calls will be answered, but messages most likely taken and calls returned from our staff working from home. Emails will all still be answered promptly and any ongoing cases will continue to be progressed. Where an appointment in person is urgent and unavoidable (for example signing a Will or a crucial legal document), these will still be taking place at our office, but with strict social distancing measures in place.

If you have a legal problem that you would like advice upon, for example drafting a Will or a property issue, we are able to conduct all consultations via phone or video call, so please don’t hesitate to contact us if you need legal assistance.

These policies are being reviewed very regularly and if the situation changes again we will publish details. But for the foreseeable future, please do not attend our offices unless it is for a pre-arranged appointment or to drop off crucial documents, which should be posted through the letterbox at our office in Shirley.

Thank you for your continued support. Best wishes to you all and your families from all the team at Wadsworths Solicitors.

Corona Virus Update…

As the current Corona Virus situation unfolds, we wanted to take a moment to update you with the action we’re taking to protect our staff, clients and friends, whilst still maintaining the consistent and reliable high-quality legal services we are known for.

Unless and until government advice changes, our offices in both Shirley and Henley-in-Arden will remain open. Whilst the highest standards of hygiene are being maintained amongst all staff members, shaking hands and close physical proximity is being discouraged.

In line with government advice, we are encouraging those members of staff who can work from home to do so, however please be reassured this will not impact on the day to day running and progress of existing and/or new legal matters. Please call the office during normal working hours to speak to us about your case as you would usually.

Should you require a face to face meeting at one of our offices, this can be arranged, however we are pleased to announce we will shortly be rolling out “virtual appointments” whereby a video call can be arranged for both new and ongoing work – watch this space for further details.

These are unprecedented times and like you, we are very much looking forward to getting back to normal! Until then, the Directors and staff at Wadsworths Solicitors continue to work hard to ensure every client’s experience with us remains as stress-free as possible.
